Statement of Intent

Generally, this district covers areas that have been traditional village centers or the site of seafood processing operations. It is intended for the conduct of business to which the public requires direct and frequent access in addition to primary residences. This district will provide area in which residential and commercial uses can be commingled in a mutually supportive manner, and provides for the location of a business and a residence in the same building. This district is designed to encourage the high density location of permitted uses as a means of revitalizing traditional village areas and making the delivery of goods and services more cost effective. It will serve as the alternative to strip development along currently undeveloped traffic corridors, a practice that will be discouraged. It is also designed to provide the option of establishing or reestablishing seafood-processing operations and other waterfront commercial activities in areas of residential development where the amount of available area adjacent to the water is sufficient for such activities.

21-1. Use regulations.

A rural village area shall be defined and approved. Once defined, it is included in this district. In the Rural Village Overlay, All Districts, structures to be erected or land to be used shall be for one or more of the following uses:

21-1-1. Single family residences.

21-1-2. Multi-family residences or cluster homes with approved master plan.

21-1-3. Residences located in the same building as a business. Residences can be above the business, below it, or attached to it. Residence portion of the shared building must conform to building codes for residential structures.

21-1-4. Retail food stores.

21-1-5. Bakeries.

21-1-6. General stores.

21-1-7. Antique shops and art galleries.

21-1-8. Dry cleaners.

21-1-9. Laundry and dry cleaning, to include coin-operated laundry facilities limited to 4000 square feet of floor area.

21-1-10. Wearing apparel stores.

21-1-11. Drug and variety stores.

21-1-12. Barber and beauty shops.

21-1-13. Appliance sales and service.

21-1-14. Auto sales and service.

21-1-15. Auto repair and service stations limited to 4000 square feet of floor area.

21-1-16. Theaters and assembly halls.

21-1-17. Hotels, motels, tourist homes.

21-1-18. Office buildings, business offices, banks, savings and loan, and other professional buildings.

21-1-19. Churches.

21-1-20. Libraries.

21-1-21. Hospitals, general and private.

21-1-22. Funeral homes.

21-1-23. Printing and framing shops or offices.

21-1-24. Restaurants.

21-1-25. Clubs and lodges.

21-1-26. Lumber and building supply, home improvement supplies, and farm supplies.

21-1-27. Plumbing, electrical, heating and air conditioning supply, sales and service.

21-1-28. Building contractors.

21-1-29. Contractors' equipment storage yards.

21-1-30. County-sanctioned public facilities.

21-1-31. Public utilities.

21-1-32. Off street parking as required by this ordinance.

21-1-33. Public billiard parlors and pool rooms, bowling alleys, dancehalls, and similar forms of public amusement with a special exception. (NOTE: In approving such application, the board of supervisors may establish special requirements and regulations for the protection of adjacent property, set the hours of operation, and make requirements as it may deem necessary in the public interest).

21-1-34. Post office.

21-1-35. Major recreational equipment in accordance with article 19 of this ordinance.

21-1-36. Horticultural nurseries, and greenhouses with garden and plant supplies.

21-1-37. Flower sales and supplies.

21-1-38. Child care or day care centers.

21-1-39. Veterinary hospitals and/or kennels limited to 5000 square feet of floor space.

21-1-40. Bookstores, stationery and office supply stores.

21-1-41. Camera and photography sales and service.

21-1-42. Exterminating companies sales and service.

21-1-43. Furniture stores and carpet stores.

21-1-44. Hardware, paint, floor covering and fabric stores.

21-1-45. Hobby and craft shops.

21-1-46. Insurance agencies.

21-1-47. Interior decorating stores.

21-1-48. Jewelry and gift shops, sales and service.

21-1-49. Locksmiths.

21-1-50. Mail order and catalogue stores.

21-1-51. Music stores.

21-1-52. Optical sales and service.

21-1-53. Real estate sales offices and other brokerage sales offices.

21-1-54. Sporting goods stores.

21-1-55. Swimming pools sales and service.

21-1-56. Television and radio sales and service, stereo sales and service.

21-1-57. Travel agencies.

21-1-58. Automobile assembling, painting, upholstering, repairing, rebuilding, reconditioning, body and fender work, and truck repairing or overhauling.

21-1-59. Cabinet, furniture and upholstery shops.

21-1-60. Public utility generating, booster or relay stations, transformer substations, transmission lines and towers, and other facilities for the provision and maintenance of public utilities, including telecommunications and water and sewer lines.

21-1-61. Office buildings for executive, administrative, business, educational or professional services.

21-1-62. Marine sales.

21-1-63. Boat building and repair.

21-1-64. Commercial marina including boat and accessory sales, boat storage, engine and boat repairs.

21-1-65. Finfish and shellfish processing, packaging, compounding, or treatment.

21-1-66. Bait and tackle, and fishing and boating supplies store.

21-1-67. Yacht club.

21-1-68. Computer and data processing services.

21-1-69. Mailing, reproduction, commercial art and photography, and stenographic services.

21-1-70. Repair and rental of light machinery and equipment.

21-1-71. Factory outlets and retailing.

21-1-72. Garages and storage buildings.

21-1-73. Cafeterias for employees of the permitted use in which it is located.

21-1-74. Radio and/or signal transmission towers less than 35 feet in height above ground level, located in the rear or side yard. Towers greater than 35 feet in height above ground level may be placed with a special exception.

21-1-75. Trucking terminals/offices or warehouse facilities.

21-1-76. Retail sale, wholesale, lease or licensing of goods or services directly to a user, manufacturer, distributor, retailer or customer using computers or telecommunications.

21-2. Requirements for permitted uses

21-2-1. Before a building permit shall be issued or construction commenced on any permitted use in this zoning district, or a permit issued for a new use, plans, in sufficient detail to show the operations, processes and information as required by article 22, site plans, shall be submitted to the zoning administrator.

21-2-2. For permitted uses utilizing individual sewage disposal systems, the health official shall approve required area for such. The administrator may require a greater area or connection to a municipal sewage treatment facility if considered necessary by the health official and approved by the board of supervisors. Conditional septic disposal system permits that limit the use of the subject property to a specified portion of the year are hereby strictly prohibited.

21-2-3. Sufficient area shall be provided:

(a) To adequately screen permitted uses and storage materials from adjacent properties;

(b) For off-street parking of vehicles incidental to the business, its employees and clients;

(c) To plant necessary vegetative buffers and other types of landscaping that enhances aesthetic appeal of the structure; and

(d) For adequate density of development.

21-3. Setback regulations

Buildings or structures, excluding signs, shall be located no less than 60 feet from the nearest edge of the right-of-way of any street or road. This shall be known as the "setback line."

21-4. Yard regulations.

For permitted uses, the minimum side yard adjoining or adjacent to a residential or agricultural district shall be 25 feet and off-street parking shall be in accordance with the provisions contained herein.

21-5. Height regulations.

21-5-1. Buildings may be erected up to 24 feet in height from grade. However, the height limit may be increased to 35 feet for any building when side yards of at least 25 feet are provided. Chimneys, flues, flagpoles, television antennae, communication towers, and radio aerials are specifically exempt from this requirement except as may be provided for elsewhere in this article. Parapet wall may be up to four feet above the height of the building on which the wall rest.

21-5-2. A public or semipublic building such as a school, church, library, or general hospital may be erected to a height of 60 feet from grade, subject to such conditions deemed necessary by the board of supervisors.

21-5-3. No accessory structure that is within ten feet of any property lot line shall be more than one story high. All accessory structures shall be less than the main structure in height.

21-6. Sign regulations.

Sign regulations shall conform to article 11 of this ordinance.
